Here is my scenario...
1. Applied my first EAD thru some lawyer (hence G-28)
2. I am planning to renew it on "my own"
Can I renew EAD without Attroney help... I know the answer "YES" but the main question is... do I need to inform USCIS saying that I want to withdraw my lawyer's and hence G-28 which was filed along with my first EAD?
If anyone are sucessful, please help me...My question is not on how to self apply EAD..My question is whether we need to inform USCIS about G-28...

Hi!
I need to know when can I fly back to US on my H4 visa(valid till 2011 ).
My husband has joined a new job and his H1 B transfer has been filed .
Do I have to wait for new I 797 or Can I just travel on my old H4 visa and
visa transfer receipt notice .( he is filing the H1 transfer by premium processing ) .
His new employer is suggesting me to reenter on old h4 and before my husband
joins their company .
But for me that will be very soon ( not fulfilling the purpose of my visit ).
Any help is much appreciated.:confused:

My 485+140 is currently with my lawyers for filing.
In the meantime, my wife's dates went current. Her lawyer says it is ok to apply her 485 and it is preferred so we have a backup.
However, BCIS might get confused and ask us to pick one 485 at a later date - but the lawyer advises to file it now and face it later.
1) Has anyone does this?
2) Should my wife apply EAD and AP as well or just 485?
3) What are the problems I should expect?

Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?
Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!

Hi, I have approved H1b through company "NewCompany" but my GC sponsoring company "GCcompany" is planning to cancel my APPROVED 140. Again, I know USCIS will do inted to deny and Yes, I have filed for 485 + it's been 180+ days but I guess the most important question of all is:-
"Will this affect my H1B status?' Since the approval for new 3 year (extension) was based on my 140 and now this thing is under jeopardy. If I use EAD, my wife will no longer be H4 and thats a different problem- Gosh when is thind going to end?"

I am planning to renew my passport. Current passport is going to expire in October 2008.
Currently my I-485 is pending. If I renew my passport, do I need to update my renewed passport number to USCIS?
I never updated USCIS about the new passport.Recently I re-entered US and used a new passport with AP. I had no issues at all. So, I think it shoud be ok. They may just update your new passport number in the system when you re-enter the country the next time.

My wife and I both have EAD and AP. My wife is derivative on my 485 application. I am using H1b for employment though, while my wife is using EAD for employment.
We are planning to travel to India. I am going to continue to use my H1 b as I am going for visa stamping on my trip to India. My wife will be using AP for reentry.
Questions:
1) Do you see any complications while reentering in this scenario either for me or for my wife since I will be using H1 visa and she will be using AP.
2) Does she need to carry her employment verification letter since she is derivative of my application? Can the IO at poe entry ask for her employment? What should she be saying her purpose of visit or any such questions? Would it be ok to mention 'pending AOS' as the status.

Your wait really starts when you gets your I140 approved. After that you can do all is to wait for 8/9/10/11 dates every month to watch the visa bulletins [:(]
